OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a flash fire hazard from the uncontrolled release of flammable digester gas: On or about June 14, 2022, the digestion tank, used in the process of digesting flammable gases (methane and biogas) from organic liquid substrate, presented a flash fire hazard related to the uncontrolled release of flammable gas from the vessel originating from excessive internal pressures developed during unplanned shutdown conditions.

29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: On or about June 14, 2022, the employer failed to develop and implement an emergency response plan. There was a rupture of the roofing membrane on the Digester Tank after a power-outage caused the digesters/agitators to stop mixing effluent, resulting in a build-up of effluent-foam and methane within the tank and a subsequent rupture and flash fire due to methane release on June 14, 2022, which resulted in injured and hospitalized workers. The workers were completing emergency response tasks at the time of the rupture and flash fire.
