29 CFR  1926.20(b)(2): Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a) On or about June 14, 2022, the employer did not ensure that a frequent and regular inspection program was being maintained in use by a competent person to ensure that job site, material and equipment; such as but not limited to personal protective equipment that is appropriate for working energized on equipment such as the 480v energized circuit that was being moved.

29 CFR  1926.95(a): Personal Protective and Life Saving Equipment. Criteria for personal protective equipment. "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.  a) On or about June 14, 2022, the employer did not ensure that employees working for a new commercial tenant The Frost Factory did not used electrical protective equipment that is appropriate to protect employees from exposure to electrical burns on the arms and face from an energized electrical source of 480v.

29 CFR  1926.416(a)(1): General requirement. Protection of employees. No employer shall permit an employee to work in such proximity to any part of an electric power circuit that the employee could contact the electric power circuit in the course of work, unless the employee is protected against electric shock by deenergizing the circuit and grounding it or by guarding it effectively by insulation or other means.  a) On or about June 14, 2022, the employer did not ensure that employees working in the electric room for The Frost Factory a new retail tenant at a commercial building were not exposed to electrical shock when working with the 480v energized circuit that was being moved by ensuring that the circuit had been de-energized prior to moving.
