OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to caught between and/or struck-by hazards: a) Schuetz Container Systems located at 2105 South Wilkinson Way, Perrysburg, Ohio, on or about June 15, 2022, at the SGSA A22 in the Grid Weld area of the Intermediate Bulk Containers (IBC), two below-the-hook lifting devices attached to an overhead crane's hook used to restock the profile and mid-horizontal tube rack and move completed and banded grids, did not maintain an identification plate or any other means to indicate the lifting device's lifting capacity, thereby exposing the employees to a struck-by and/or caught between hazard.

29 CFR 1910.184(d):Each day before being used, the sling and all fastenings and attachments were not being inspected for damage or defects by a competent person designated by the employer: a) Schuetz Container Systems located at 2105 South Wilkinson Way, Perrysburg, Ohio, on or about June 15, 2022, at the SGSA 22 in the Grid Weld area of the Intermediate Bulk Containers (IBC), the employer failed to ensure that a competent person inspected the synthetic web slings and attachments used in conjunction with the overhead crane prior to employees operating the crane, exposing employees to potential struck by hazards.
