29 CFR 1910.178(l)(1)(ii):The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck. On or about June 16, 2022, the employer did not ensure that employees who were authorized to operate powered industrial vehicles were certified. The employees had not been trained and evaluated as required. No forklift operators have been sent for training. The employer acknowledged that they did not perform any forklift training or certification for employees who operate the lift truck. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: On or about June 16, 2022, the employer did not develop and implement an energy control program consisting of energy control procedures for equipment and employee training to protect them while engaged in cleaning and maintenance activities. Employees were exposed to crushing and amputation injuries from unexpended startup on the silica bagging machine. No abatement is required for this citation item.
