29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a) Lot 32 of the 49 Pines Development in Dover, DE 19904: On or about June 16, 2022, the employer failed to ensure employees conducting air conditioning installation work on a single family home being constructed while being unprotected due to unguarded holes in the wall, approximately 13 feet above grade, were provided adequate fall protection.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access: a) Lot 32 of the 49 Pines Development in Dover, DE 19904: On or about June 16, 2022, the employer failed to ensure employees used ladders that extended at least 3 feet above the upper landing to access the upper levels of a multi story building, exposing employees to fall hazards.
