29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by, caught between and crushing hazards from falling granite curbing where the equipment manufacturer's instructions had not been followed while off-loading granite curbing. Location: Construction Material Storage Area 1. Employees were exposed to struck-by, caught between and crushing hazards while working where the John Deere 332G Skid Steer Loader hoisting granite curbing exceeded the manufacturer's rated operating load capacity. 2. Employees were exposed to struck-by, caught between and crushing hazards while working where the John Deere 332G Skid Steer Loader hoisting granite curbing operated on a sloping, wet and uneven ground surface.
