29 CFR 1926.602(a)(3)(i): No employer shall move or cause to be moved construction equipment or vehicles upon any access roadway or grade unless the access roadway or grade is constructed and maintained to accommodate safely the movement of the equipment and vehicles involved. Kiewit Barnard a Joint Venture, at Gross Dam Reservoir: On and before June 18, 2022, the employer did not ensure that all grades were constructed and maintained to accommodate safely the movement of the equipment and vehicles involved, in that employees were exposed to fall hazards estimated at 100 feet or greater while operating heavy equipment such as, but not limited to, a CAT 773F, on an unprotected grade. This condition exposes employees to injuries such as contusions, fractures, and death.
