Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to burns from explosion/flash fire. a) 3786 North Hess Road, Waterfall PA - Incinerator Room/Adjacent Area - On or about June 22, 2022, an employee utilizing a Fire Lake C12-400 incinerator to burn marijuana plant waste experienced a system backfire and subsequent explosion/flash fire. The employer was not enforcing internal operating standards for the incinerator process; therefore, exposing employees to explosion/fire/burn hazards. No abatement certification or documentation required.
