29 CFR  1910.134(a)(2): A respirator shall be provided to each employee when such equipment is necessary to protect the health of such employee. The employer shall provide the respirators which are applicable and suitable for the purpose intended. The employer shall be responsible for the establishment and maintenance of a respiratory protection program, which shall include the requirements outlined in paragraph (c) of this section. The program shall cover each employee required by this section to use a respirator.  On or about March 24, 2022, at the facility located at 5100 West Schroth Lane, Appleton, WI, employees  were not provided NOISH-approved N-95 or equivalent or higher-level respirators when performing close contact resident care for suspected or positive COVID-19 residents.

This exposure determination shall contain the following: (A) A list of all job classifications in which all employees in those job classifications have occupational exposure; (B) A list of job classifications in which some employees have occupational exposure, and (C) A list of all tasks and procedures or groups of closely related task and procedures in which occupational exposure occurs and that are performed by employees in job classifications listed in accordance with the provisions of paragraph (c)(2)(i)(B) of this standard:  On or about June 23, 2022, at the facility located at 5100 West Schroth Lane, Appleton, WI, the employer had not determined job classifications which all or some employees have occupational exposure to blood and other potential infectious materials  or listed the tasks and procedures or groups of closely related task and procedures in which occupational exposure may occur.
