29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: (a) Mother Loade Brewery Limited Liability Company DBA Tommyknocker Brewery & Pub Limited Liability Company at 1401 Miner Street in Idaho Springs, Colorado: On or about June 23, 2022, and at times prior, the employer did not implement a permit space program to ensure safe employee entry into the mash tun. The mash tun met the definition of a permit space, and brewers regularly entered the space without removing safety hazards, such as corrosive cleaning chemicals and hot water. This condition exposed employees to burn hazards. (b) Mother Loade Brewery Limited Liability Company DBA Tommyknocker Brewery & Pub Limited Liability Company at 1401 Miner Street in Idaho Springs, Colorado: On or about June 23, 2022, and at times prior, the employer did not implement a permit space program to ensure safe employee entry into the brew kettle. The brew kettle met the definition of a permit space, and brewers regularly entered the space without removing safety hazards, such as steam and hot surfaces. This condition exposed employees to burn hazards.
