OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and caught between hazards associated with heavy equipment use: a) Worksite, Master Street, Johnsonville, New York: On or about June 24, 2022, an employee was scraping asphalt with A T650 Bobcat Skid Steer without ensuring employees were clear from the work area, exposing the employee to struck-by hazards.

29 CFR 1904.4(a): The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. On or about June 24, 2022 until December 13, 2022, the employer did not record the following workplace injuries or illnesses on the OSHA 300 form for the calendar year 2022. a) Worksite, Master Street, Johnsonville, New York: On or about June 24, 2022, an employee's arm was caught in between the tailgate and the bed of the dump truck and sustained an arm fracture. The injury resulted in medical treatment beyond first aid.
