OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high ambient heat while performing jobs duties.   On or about June 24, 2022, and at times prior thereto, workers were exposed to the hazard of high ambient heat from direct sun during the performance of their job duties, including framing, installing trusses, and wall installation on residential construction for at least two days.  The heat index was 100.2 F/37.8 C at the time of the inspection, with a WBGT(o) of 89.4 F/ 31.9 C, and a metabolic work rate of 415.  Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   East side of the construction site: On or about June 24, 2022, and at times prior thereto, workers were exposed to a fall hazard greater than 6 feet while installing the framing on a residential construction site without fall protection.
