29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Spring Hill Suites by Marriott in Frederica, DE 19946: On or about June 24, 2022, the employer failed to ensure employees conducting framing operations on a hotel being constructed while being unprotected in all directions, approximately 30 feet above grade, were provided adequate fall protection. The Duran's Carpentry, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1529499, citation number 1, item number 1 and was affirmed as a final order on December 1, 2021 with respect to a workplace located at Building 1 40 East Street Camden, DE 19934.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: a) Spring Hill Suites by Marriott in Frederica, DE 19946: On or about June 24, 2022, the employer failed to provide a ladder high enough for the employees to appropriately access the frame of a future window installation. There was only a 6 foot step ladder in place for an employee to step onto the top step and top of that ladder to gain access to the upper level of a window frame. The Durans Carpentry, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(13), which was contained in OSHA inspection number 1529499, citation number 1, item number 2 and was affirmed as a final order on December 1, 2021 with respect to a workplace located at Building 1 40 East Street Camden, DE 19934.
