29 CFR  1926.651(j)(1):Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face:  a) Worksite at 309 North 20th Street, Allentown PA: On or about June 24, 2022,  employees performing plumbing duties such as installing sewer line were exposed to the hazard of potential loose rock or soil, and the employer did not provide adequate protection to prevent falling rock or soil, exposing employees to struck by hazards.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR  1926.651(j)(2):Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  a) Worksite at 309 North 20th Street, Allentown PA: On or about June 24, 2022,  spoil piles were placed less than 2 feet from the trench, exposing employees performing duties such as installing sewer line  to serious injury in event of material falling into the trench.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.

29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a) Worksite at 309 North 20th Street, Allentown PA: On or about June 24, 2022,  employees worked in a trench greater than 5 feet in depth that did not have adequate protective system installed, exposing employees to the hazards of engulfment and trench collapse.   Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states that employees and their representatives were informed of this abatement.
