29 CFR 1910.147(c)(7)(iii)(A): Retraining shall be provided for all authorized and affected employees whenever there is a change in their job assignments, a change in machines, equipment or processes that present a new hazard, or when there is a change in the energy control procedures. a) On or about June 17, 2022, the employer did not retrain tumbler line operators when their job assignment was changed to include responsibility for adjusting and repositioning guides on the tumbler feed belt. Machine operators needed additional authorized employee training in energy control methods for that equipment including de-energization sequence and release from lockout, and recognition and use of all energy isolating devices.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: Each employee was not required to: (1) turn off and shut down the machines, (2) physically locate and operate energy isolating devices in such a manner as to isolate the machine or equipment from the electric and pneumatic energy sources, (3) affix lockout or tagout devices to each energy-isolating device, (4) verify the effectiveness of energy isolation. a) On or about June 17, 2022, the machine operator performing servicing operations, did not lock out the electrical disconnects when performing tasks such as replacing and making adjustments to the wood guides that were located on the sides of the tumbler feed belt.

29 CFR 1910.147(f)(1)(ii): Additional requirement - Testing or positioning of machines, equipment or components thereof. In situations in which lockout or tagout devices must be temporarily removed from the energy isolating device and the machine or equipment energized to test or position the machine, equipment or component thereof, the following sequence of actions shall be followed: Remove employees from the machine or equipment area in accordance with paragraph (e)(2) of this section; a) On or about June 17, 2022, when maintenance employees were tracking the belt alignment while it was running, the work area was not checked to ensure that all employees were in a safe position, resulting in an operator employees hand being pulled into the pulley of the belt.

Pulleys, any parts of which are seven (7) feet or less from the floor or working platform, shall be guarded in accordance with the standards specified in paragraphs (m) and (o) of this section. Pulleys serving as balance wheels (e.g., punch presses) on which the point of contact between belt and pulley is more than six feet six inches (6 ft. 6 in.) from the floor or platform may be guarded with a disk covering the spokes. a) On or about June 17, 2022, the pulley located on the tumbler feed belt was not guarded to prevent employees from getting caught in it.

29 CFR 1910.219(e)(1)(i): Where both runs of horizontal belts are seven (7) feet or less from the floor level, the guard shall extend to at least fifteen (15) inches above the belt or to a standard height, except that where both runs of a horizontal belt are 42 inches or less from the floor, the belt shall be fully enclosed in accordance with paragraphs (m) and (o) of this section. a) On or about June 17, 2022, on the tumbler feed belt that was located less than 7 feet from floor level, the silver plate was not flush against the belt to prevent an ingoing nip point.
