29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Brookings Roofing, Inc. at 216 West Second Street South, Brookings, SD 57006: On or about and at times prior to June 27, 2022, the controlling employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontracted employees were conducting roofing operations on a commercial building roof without the use of a fall protection system. This condition exposed subcontractor employees to fall hazards of greater than six feet.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: (a)Brookings Roofing, Inc. at 216 West Second Street South, Brookings, SD 57006: On or about and at times prior to June 27, 2022, the controlling employer did not ensure that subcontractor employees were protected from falls while conducting roofing operations on a commercial building roof. This condition exposed the subcontractor employees to fall hazards greater than six feet.
