29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Phillips Home Improvements. On or about June 27, 2022, at the address of 317 Wayne Ave. Defiance, OH 43512: The employer did not ensure employees using aluminum ladders had their side rails extended at least three feet above the landing surface. Four employees and two minors were exposed to fall hazards while using ladders to access a two-story residential structure with a roof eave height of 24feet from ground below.

29 CFR 1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: a) Phillips Home Improvements. On or about June 27, 2022, at the address of 317 Wayne Ave. Defiance, OH 43512: The employer did not have a plan or program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness. Employees working in these conditions were exposed to falls of up to 24 feet or greater. Phillips Home Improvements was previously cited for a violation of this Occupational Safety and Health Standard 1926.20(b)(1), which was contained in OSHA inspection number 1568890, citation number 1, item number 1a and was affirmed as a final order on May 5, 2020, with respect to a workplace located at 815 E, 2nd St., Defiance, OH 43512.

On or about June 27, 2022, at the address of 317 Wayne Ave. Defiance, OH 43512: The employer did not ensure that employees had been trained in the appropriate use of fall protection such as but not limited to the use of personal fall arrest systems or alternative measures while performing roofing operations from elevated surfaces greater than six feet from the level below. Employees working in these conditions were exposed to falls of up to 24 feet or greater. Phillips Home Improvements was previously cited for a violation of this Occupational Safety and Health Standard 1926.503(a)(1), which was contained in OSHA inspection number 1568890, citation number 1, item number 1b and was affirmed as a final order on May 5, 2020, with respect to a workplace located at 815 E, 2nd St., Defiance, OH 43512.
