The employer directed Plumber employees to work in the Pump Pit and the competent person did not identify it as a confined space or permit space through consideration and evaluation of the elements of the Pump Pit. Employees entered the confined space of the Pump Pit via extension ladder and worked in the pit which had the potential for a hazardous atmosphere caused by combustion-engine byproducts and/or hydrogen sulfide from near-by manure processes.

29 CFR  1926.1203(f):  When there are changes in the use or configuration of a non-permit confined space that might increase the hazards to entrants, or some indication that the initial evaluation of the space may not have been adequate, each entry employer must have a competent person reevaluate that space and, if necessary, reclassify it as a permit-required confined space:  At a worksite located at 1251 Mill Road, Green Leaf, WI 54126; when a change in configuration of the Pump Pit occurred, which increased the hazards to entrants, the employer did not have a competent person reevaluate that space to reclassify as a permit-required confined space. When the employer introduced a gas-engine powered pump to the Pump Pit, and when hydrogen sulfide was introduced to the work site which could enter the Pump Pit, the employer's competent person did not reevaluate or reclassify the Pump Pit as a permit-required confined space. Employees entered the confined space of the Pump Pit via extension ladder and worked in the pit which had the potential for a hazardous atmosphere caused by combustion-engine byproducts and/or hydrogen sulfide from near-by manure processes.

29 CFR  1926.1203(d):  If any employer decides that employees it directs will enter a permit space, that employer must have a written permit space program that complies with �1926.1204 implemented at the construction site. The written program must be made available prior to and during entry operations for inspection by employees and their authorized representatives.   At a worksite located at 1251 Mill Road, Green Leaf, WI 54126; the employer's  written permit space program did not contain all the elements required by �1926.1204 and the employer did not implement their written permit space program when the employer direct employees to enter and work in a permit-required confined space (PRCS). The employer did not complete entry permits, did not ensure an attendant and/or entry supervisor were present outside the permit space, and did not facilitate non-entry rescue retrieval systems or other methods of retrieval; when employees entered the confined space of the Pump Pit via extension ladder and worked in the pit which had the potential for a hazardous atmosphere caused by combustion-engine byproducts and/or hydrogen sulfide from near-by manure processes.  All provision of 29 CFR 1910.1204(a) through (n) shall be included in a written permit space program. Key provisions include, but are not limited to the following:  1)  Written PRCS program 2)  Entry permit and permit system 3)  Training for Entrants, Attendants and Supervisors 4)  Rescue and emergency services
