OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to high ambient heat:  a) On June 13, 2022, four employees were exposed to the hazard of high ambient heat from direct sunlight during the performance of their job duties, including the harvesting of various produce, such as peppers, for a duration of up 10 hours per day. The calculated Wet Bulb Global Temperature (WBGT) ranged from 30.5 �C to 40.3 �C (86.9 �F to 104.5�F) while working outdoors performing moderate manual labor and wearing long sleeves and pants. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. Two employees showed signs and symptoms of heat-related illnesses, including vomiting, weakness, and headache and were treated at a local clinic.   b) On June 15, 2022, an employee was exposed to the hazard of high ambient heat from direct sunlight during the performance of their job duties, including the harvesting of various produce, such as peppers, for a duration of up 10 hours per day. The calculated Wet Bulb Global Temperature (WBGT) ranged from 26.6 � C to 41.9 � C (89.0 �F to 104.2�F) while working outdoors performing moderate manual labor and wearing long sleeves and pants.  Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. An employee showed signs of and symptoms of heat-related illness, including heat syncope.  c) On June 16, 2022, an employee was exposed to the hazard of high ambient heat from direct sunlight during the performance of their job duties, including the harvesting of various produce, such as peppers, for a duration of up 10 hours per day The calculated Wet Bulb Global Temperature (WBGT) ranged from 28.1 � C to 34.4 � C (83.5 �F to 109.3�F) while working outdoors performing moderate manual labor and wearing long sleeves and pants. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke. An employee showed signs of and symptoms of heat-related illness, including heat exhaustion.  d) On June 24, 2022, employees were exposed to the hazard of high ambient heat from direct sunlight during the performance of their job duties, including the harvesting of various produce, such as peppers, for a duration of up 10 hours per day The calculated Wet Bulb Global Temperature (WBGT) ranged from  28.0 � C to 41.3 � C (82.4 �F to 106.3�F) while working outdoors performing moderate manual labor and wearing long sleeves and pants. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.   e) On June 25, 2022, employees were exposed to the hazard of high ambient heat from direct sunlight during the performance of their job duties, including the harvesting of various produce, such as peppers, for a duration of up 10 hours per day The calculated Wet Bulb Global Temperature (WBGT) ranged from 26.4 � C to 30.8 � C (79.5 �F to 87.4�F) while working outdoors performing moderate manual labor and wearing long sleeves and pants. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.

29 CFR  1904.41(a)(1): The establishment had 250 or more employees at any time during the previous calendar year, and the establishment was classified in an industry listed in appendix A to subpart E of this part, and the employer did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee by the specified date:   a) Golden Eagle Ag Labor Contractors, LLC: On or about June 23, 2022, the employer failed to electronically submit information from their OSHA Form 300A, Summary of Work-Related Injuries and Illnesses or equivalent form, for calendar year 2021 on or before March 2, 2022.  The establishment employed up to 400 employees during calendar year 2021 and was classified under NAICS code 115115.
