29 CFR  1910.177(c)(2):The employer did not assure that each employee demonstrated his ability to safely service rim wheels by effective performance of all tasks listed in 29 CFR 1910.177(c)(2)(i) through (viii):  Rush Repairs & Recovery, LLC - Clyde, Ohio: On or about June 21, 2022, the employer did not ensure that employees who serviced wheel rims demonstrated safe performance of servicing tasks such as, but not limited to, inspection of rim wheel components, use of rubber lubricant, use of a restraining device, and remaining outside of the trajectory during inflation and inspections.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.177(d)(4):The employer did not furnish or assure that employees use an air line assembly which includes a clip-on chuck, an inline valve with a pressure gauge or a presettable regulator, and a sufficient length of hose between the clip-on chuck and the in-line valve (if one is used) to allow the employee to stand outside the trajectory.  Rush Repairs & Recovery, LLC - Clyde, Ohio: On or about June 21, 2022, employees were exposed to struck-by injuries in that a clip-on chuck, in-line valve with pressure gauge and sufficient length hose was not provided and/or used to allow an employee to stand outside of the trajectory while inflating a tire(s).  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR  1910.177(g)(8): The employer did not ensure that employees stay out of the trajectory when inflating a tire on a single piece rim wheel:  Rush Repairs & Recovery, LLC - Clyde, Ohio: On or about June 21, 2022, the employer did not ensure that employees remained outside the trajectory when inflating a tire for a single piece rim.  An employee who was within a tire's trajectory was injured when a tired failed during inflation.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1910.177(g)(3):The employer did not ensure that employees apply nonflammable rubber lubricant to bead and wheel mating surfaces before assembly of rim wheels.  Rush Repairs & Recovery, LLC - Clyde, Ohio:  On or about June 21, 2022, employees were exposed to struck-by hazards in that a nonflammable rubber lubricant was not applied for a proper seal, prior to mounting a tire on a single piece rim wheel.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR  1910.177(g)(6):Tires on single piece rim wheels were not contained within a restraining device, positioned behind a barrier or bolted on the vehicle with the lug nuts fully tightened during tire inflation.  Rush Repairs & Recovery, LLC - Clyde, Ohio: On or about June 21, 2022, the employer did not ensure that tires were contained in a restraining device during inflation, exposing employees to struck-by hazards. An employee was hospitalized after being struck by a tire that failed during the mounting process.     No additional abatement information is needed for this item.
