29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Y4 Framing and Roofing LLC, at the jobsite located at 502 Morrison Rd., Gahanna, Ohio 43230: On and/or preceding June 28, 2022, the employer did not ensure that fall protection was utilized by employees engaged in framing activities to a residential apartment complex, thereby exposing employees to fall hazards greater than 32 feet.  Y4 Framing and Roofing LLC was previously cited for a Willful-Serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1573558, citation number 2, item number 1 and was affirmed as a final order on 2/16/2022, with respect to a workplace located at 2780 Gail Avenue, Columbus, OH 43224.  Y4 Framing and Roofing LLC was previously cited for a Willful-Serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1553433, citation number 1, item number 1 and was affirmed as a final order on 11/03/2021, with respect to a workplace located at 4317 French Circle Drive, Columbus, OH 43207.  Y4 Framing and Roofing LLC was previously cited for a Repeat-Serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1465595, citation number 1, item number 1 and was affirmed as a final order on 06/22/2020, with respect to a workplace located at 1880 Welsh Place, Marysville, OH 43040.  Juan Maya Samano was previously cited for a Repeat-Serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1418877, citation number 2, item number 1B and was affirmed as a final order on 12/17/2019, with respect to a workplace located at 412 Melick Drive, Delaware, OH 43015. Y4 Framing and Roofing LLC was previously cited for a Repeat-Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1573558, citation number 1, item number 3 and was affirmed as a final order on 2/17/2022, with respect to a workplace located at 201 Haughton Lane, Lewis Center, Ohio 43035. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a) Y4 Framing and Roofing LLC, at the jobsite located at Morrison Rd. & Waterbury Ct., Gahanna, Ohio 43230: On and/or preceding June 28, 2022, the employer the employer failed to provide employees a fall protection training program for the recognition of fall hazards and procedures to be followed to minimize these hazards. Employees without fall protection training were engaged in roofing activities, thereby exposed to fall hazards greater than 32 feet.  Juan Maya Samano was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(a)(1), which was contained in OSHA inspection number 1418877, citation number 1, item number 1 and was affirmed as a final order on 12/17/2019, with respect to a workplace located at 412 Melick Dr., Delaware, OH 43015.
