29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a) New residential construction located on Lot# B613 at 180 Central Avenue, Fayetteville, GA 30215, West side of the structure: On or about 06/28/2022, the employer exposed employees to falls of approximately 10-feet, 6-inches to the lower ground level, in that a that a ladder which extended at least 3-feet past the roof landing was not provided to employees accessing the roof and ground levels.

29 CFR  1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:   a) New residential construction located on Lot# B613 at 180 Central Avenue, Fayetteville, GA 30215, West side of the structure: On or about 06/28/2022, the employer exposed employees to falls of approximately 10-feet, 6-inches to the lower ground level, in that a step ladder was used in the closed position and was not used with all four feet on a level surface with the spreader bars fully engaged as required by the manufacturer.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a) New residential construction located on Lot# B613 at 180 Central Avenue, Fayetteville, GA 30215, Roof: On or about 06/28/2022, the employer exposed employees to falls of approximately 11-feet, 2-inches to the lower ground level, in that a complete fall protection system was not provided to employees engaged in plywood installation activities on a flat roof.  Sustaita Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1480536, citation number 1, item number 1 and was affirmed as a final order on 08/05/2020, with respect to a workplace located on Lot B107at 185 2nd Street, Fayetteville, GA 30214.  Sustaita Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1478123, citation number 1, item number 1 and was affirmed as a final order on 08/05/2020, with respect to a workplace located at 15 Arbor Garden Circle (Lot #23), Newnan, GA 30265.
