29 CFR  1910.30(a)(1):(a) Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart.  Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017.  a. On or about June 29, 2022 the employer failed to provide training  for employees exposed to fall hazards. Employees were not trained on fall hazards in the unloading dock area and how to recognize them. Employees were exposed to fall distances of over four feet to the concreate floor below, without adequate means of fall protection/prevention when unloading industrial containers and loading them onto the conveyer system to begin the production process.

29 CFR  1910.212(a)(3)(ii):The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.   a. On or about June 29, 2022, the employer failed to protect employees from point of operation hazards created by the Richmond Automatic Beading Machine (E-2076) with complainant guarding. The following condition exposed employees to struck-by and caught-in hazards.

29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.  a. On or about June 29, 2022 and at times prior, the employer failed to guard the pinch point hazard for the lid press machine created by the movement of the press plate of the machine during the operating cycle. The machine operator has exposure to the hazard due to having to hold the industrial container drum lid rings as the lid is being pressed on. The following condition exposes employees to pinch point/struck-by hazards.   b. On or about June 29, 2022 and at times prior, the employer failed to guard the pinch point hazard for the lock press machine created by the movement of the press plate of the machine during the operating cycle. The machine operator has exposure to the hazard due to having to hold the industrial container drum lid rings as the lid is being pressed on and the ring is secured. The following condition exposes employees to pinch point/struck-by hazards.  c. On or about June 29, 2022, at the Closed Head Paint Booth, employees were exposed to machine hazards associated with moving parts when required to perform servicing/maintenance activities. Employees performed unjamming/realignment activities of industrial containers that would get hung-up between the down-ender and the loader in the paint booth during the production process.

29 CFR  1910.157(g)(4):The employer shall provide the training required in paragraph (g)(3) of this section upon initial assignment to the designated group of employees and at least annually thereafter.  [45 FR 60708, Sept. 12, 1980; 46 FR 24557, May 1, 1981, as amended at 51 FR 34560, Sept. 29, 1986; 61 FR 9227, March 7, 1996; 67 FR 67964, Nov. 7, 2002]  a. On or about June 29, 2022 and at times prior, employees were not provided with initial training or annual training thereafter on the use of portable fire extinguishers they were required to use in the event of an fire emergency. The following condition exposed employees to hazards associated with being unfamiliar with portable fire extinguishers such as but not limited to burns and smoke inhalation.

29 CFR  1910.303(b)(1):Examination. Electric equipment shall be free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined using the following considerations:  a. On or about June 29, 2022 and at times prior, the employer did not examine and ensure that electric equipment was free from recognized hazards. The employer did not examine and identify  electrical hazards such as but not limited to the missing ground pin of the fan being using on the unloading dock.  The following condition resulted in a grounding path that was not permanent, continuous and effective exposing employees to electrical shock hazards.  b.  On or about June 29, 2022 and at times prior, the employer did not examine and ensure that electric equipment was free from recognized hazards. The employer did not examine and identify  electrical hazards such as but not limited to electrical power boxes in the pad area, at the exit end of the oxidizer. Two power boxes were found to have openings that were not effectively closed. The following condition exposed employees to electrical shock hazards.  c. On or about June 29, 2022 and at times prior, the employer did not examine and ensure that electric equipment was free from recognized hazards. The employer did not examine and identify electrical hazards such as but not limited to damaged flexible power cord strain relief. On the unloading dock the flexible power cord for the fan was found to have a damaged strain relief. The following condition exposed employees to electrical shock hazards.

(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following:  a. On or about June 29, 2022 and at times prior, the employer did not ensure that employees working at heights exceeding four feet were protected from falls created by open dock doors to the concreate ground below. Employees were tasked with unloading industrial containers and loading them onto the conveyer system to begin the production process.  No means of fall protection/prevention was provided to protect employees thereby exposing them to falls exceeding four feet.  Mauser Packaging Solutions dba Industrial Container Services (ICS) was previously cited under the name Industrial Container Services - TX, LLC for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23 (c)(1), which was contained in OSHA inspection number 1319684, citation number 1, item number 1 and was affirmed as a final order on  September 18, 2018, with respect to a workplace located at 6093 NE Loop 410 Ste. 135, San Antonio, TX 78218.
