OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards from dust collection systems and from dust collectors being located inside a building: (a) Second floor custom cabinet production area: On or about June 21, 2022 the following conditions were present: (1) There was an enclosure-less dust collector used to collect wood dust located within 20 feet of areas normally occupied by employees, (2) Nonconductive duct work was used to convey wood dust to the dust collectors, (3) Flexible duct work was used extensively to convey wood dust.
