29 CFR  1926.20(b)(1):The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:  On or about June 1, 2022 the employer Marlin Byler Construction LLC, at worksite located at 9268 E. Bayshore Rd. Lakeside/Marblehead Oh 43440, did not have a plan or a program to identify job site hazards which assists employees in maintaining a safe working environment. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls and struck by hazards during job site operations, decreasing the probability of employee injury or illness.

Bayshore Rd. Lakeside/Marblehead Oh 43440, did not have a fall protection training program in place to enable each employee to recognize the hazards of falling, and procedures to minimize these hazards. Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury or illness.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:  On or about June 1, 2022 the employer Marlin Byler Construction LLC, at worksite located at 9268 E. Bayshore Rd. Lakeside/Marblehead Oh 43440, did not provide a training program for each employee potentially exposed to fall hazards while using portable ladders to enable each employee to recognize the hazards of falling from the ladder and the procedures to be followed in order to minimize these hazards. Employees were using one step ladder, and one 12 foot extension ladder on site, exposed them to falls of approximately 12 feet or greater, due to the lack of training on use of the ladders.

Bayshore Rd. Lakeside/Marblehead Oh 43440, did not  ensure each employee working on, at, above, or near wall openings, where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, was protected from falling.  Employees were exposed to fall hazards of approximately 12 feet while performing work on site.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  On or about June 1, 2022 the employer Marlin Byler Construction LLC, at worksite located at 9268 E. Bayshore Rd. Lakeside/Marblehead Oh 43440, did not ensure the side rails of one portable fiberglass extension ladder was extended at least three feet above the landing surface. Three employees were exposed to falls from approximately 12 feet or greater from the top of the second level to the decking below while using the ladder to access the second level to perform residential lumber framing activities on a commercial renovation construction jobsite.
