29 CFR  1904.39(a)(1):  The employer did not report within 8-hours the death of an employee resulting from a work-related incident:  On or about June 29, 2022:  An employee engaged in millwright activities at 317 Rd R, Shickley, Nebraska, died after falling off a grain bin.  As of the opening conference, held on July 5, 2022, the employer had not reported the death to OSHA.

29 CFR  1926.50(c):  A person who has a valid certificate in first-aid training was not available at the worksite to render first-aid:  On or about June 29, 2022:  Employees engaged in millwright activities at 317 Road R, Shickley, Nebraska were exposed to safety/health hazards related to not having an infirmary, clinic, hospital, or physician, within a reasonable time and distance from the work site, nor were there any other personnel, with a valid certificate in first-aid training, available at the worksite to render first aid.

29 CFR  1926.502(d)(21):  Personal fall arrest systems were not inspected prior to each use for wear, damage, and other deterioration, and/or defective components were not removed from service:  On or about June 29, 2022: Employees engaged in millwright activities at 317 Road R, Shickley, Nebraska, were exposed to fall hazards in that personal fall arrest equipment was not inspected prior to use.  An employee who was working on a grain bin that was 32 feet above the ground used a rope for a fall arrest system that was worn, frayed, and damaged.

29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  The employer is failing to protect employees from fall hazards associated with performing millwright work in the field.  The most recent occurrence of this was documented on or about June 29, 2022 at the jobsite located at 317 Road R, Shickley, Nebraska, where the employer has employees installing vents on the top of grain bins while using ropes tied around their waist in lieu of ANSI approved fall protection.
