29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights was no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary (for example, to fit around uprights when side brackets are used to extend the width of the platform): On or about June 28, 2022, employees were exposed to a fall hazard, while applying plasterboard and plaster, from a scaffold platform that was not fully planked. Benavidez Plastering was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.451(b)(1), which was contained in OSHA inspection number 1339240, citation number 1, item number 1, and was affirmed as a final order on December 5, 2019, with respect to a workplace located at 3533 Murphy Rd, Missouri City, TX 77459.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used: On or about June 28, 2022, employees were exposed to a fall hazard, while working from a scaffold, without a ladder attached for access. Benavidez Plastering was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1339240, citation number 1, item number 2, and was affirmed as a final order on December 5, 2018, with respect to a workplace located at 3533 Murphy Rd, Missouri city, TX 77459.
