29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   The employer is failing to ensure that employees are protected from the hazard of chemical exposures. This violation was most recently documented at a worksite located at or near 546 North Jackson St, Papillion, NE 68046 on July 6, 2022. The employer is failing to ensure a written hazard communication program is being maintained meeting the minimum requirements specified in this subpart.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  The employer is failing to provide training on the chemical hazards association with painting.  This violation was most recently documented at a worksite located at or near 546 North Jackson St, Papillion, NE 68046 on July 6, 2022. The employer has employees painting vehicles without having provide the employees any training on the use of the chemicals on site or the safety data sheets that cover those chemicals.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Thorpe's Body Shop, 546 N. Jackson St, Papillion, NE 68046  On or about July 6, 2022, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear 3M 5200 tight-fitting respirators while performing auto body surface prepping tasks that included but not limited to sanding and painting.

Jackson St, Papillion, NE 68046  On or about July 6, 2022, the employer did not provide a fit test to all employees required to wear respirators.  The employer required employees to wear 3M 5200 tight-fitting respirators while performing auto body surface prepping tasks that include but not limited to sanding and painting.
