29 CFR  1910.134(c)(1): The employer did not develop and implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use:   On or about July 7th, 2022, and at times thereafter, the employer did not ensure that they implemented an adequate, effective written respiratory protection program for all employees performing chip-out procedures to comply with all the provisions in 29 CFR 1910.134 (c)(1)(i)-(ix) with worksite specific procedures. Failure to implement an effective respiratory protection program exposes employees to adverse health effects ranging from acute respiratory illnesses to chronic pulmonary illnesses such as silicosis, asthma, and emphysema.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:  On or about July 7th, 2022, and at times thereafter, employees were required to wear respiratory protection while performing cleaning procedures inside concrete mixing drums. Without having been provided a medical evaluation, employees were potentially exposed to aggravation of preexisting medical conditions by the employer failing to have them medically evaluated prior to wearing a respirator.

29 CFR  1910.134(f)(1):The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):  On or about July 7th, 2022, the employer failed to ensure employees who were required to wear a tight-fitting respirator were fit tested to determine if the respirator seal was adequate. Employees are exposed to respirable particulates, to include crystalline silica, while performing drum cleanout activities inside concrete trucks. Failure to provide fit tests exposes employees to the potential for adverse respiratory health effects.

29 CFR  1910.253(b)(2)(ii):Cylinders were not stored in definitely assigned places away from elevators, stairs and gangways.  On or about July 7, 2022, the employer failed to ensure that a argon compressed gas cylinder was stored in a definitely assigned place to ensure that it would not be knocked over or damaged by occupants inside the facility. The cylinder was left unsecured in the office near a cabinet and door providing means of ingress/egress from the facility. Failure to secure the cylinder exposes employees to struck-by hazards, in the event the cylinder falls.

29 CFR  1910.1200(h)(1):  Employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  On or about July 7th, 2022, the employer did not train employees on the hazards of chemicals within their work area. Employees within the maintenance shop were exposed to hazardous materials including but not limited to butane, acetone, methanol, xylene, and toluene. Failure to train employees on hazardous chemicals presents significant health risks to include: burns, respiratory illness, and potential for loss of motor/sensor functions, in the event of improper handling of the chemicals.
