29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate those hazards): a) Future Site of ALDI, Inc. Store#: 144 (East Wall Scaffold System): On or about July 06, 2022, and at times prior; the controlling employer Coastal Stucco, Inc. failed to develop and implement an accident prevention program, that provided frequent and regular inspections of the job site to be made by competent person(s); exposing the employees of the sub-contractor Mid Bay Stucco, LLC to hazards such as but not limited to fall hazards from a scaffold system with missing guardrail sections.
