29 CFR  1926.25(a):  During the course of construction, alteration, or repairs,  debris was not kept cleared from work areas, passageways, and stairs, in and around buildings or other structures:  a.  On or about July 7, 2022, at the above addressed jobsite, lumber with protruding nails was not kept cleared from work areas, thereby exposing an employee to impalement and laceration hazards.

29 CFR  1926.453(b)(2)(v):  A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  a.  On or about July 7, 2022, at the above addressed jobsite, an employee performing carpentry operations from a JLG 600S Sky Power aerial lift, approximately twenty-six (26) feet above ground, was not utilizing a personal fall arrest system, thereby exposing the employee to fall hazards.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a.  On or about July 7, 2022, at the above addressed jobsite, an employee using a pneumatic nail gun was not wearing safety glasses, thereby exposing the employee to hazards associated with eye injuries.  The employer, Victor Soto Martinez dba VSM Construction was previously cited for a violation of this occupational safety and health standard, 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1263606, citation number 1, item number 1, and was affirmed as a final order on January 18, 2022, with respect to a workplace located at "Catalina West apartments", 3420 Milwaukee in Lubbock, Texas.
