(i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: (A) Guardrail Systems; (B) Safety net systems; or (C) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. a) On or about July 8, 2022, the employer did not ensure that employees working on top of a 300-ton Niagra machine press, who were exposed to a fall hazard of 20 feet, were protected by a fall protection system.

29 CFR 1910.30(a)(3)(iv): The employer must train each employee in at least the following: The correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer. a) On or about July 8, 2022, the employer did not ensure each employee was trained on the correct use of fall protection used while conducting repair work on top of a 20 foot, 300-ton Niagra machine press in that the employee was not tied off to an engineered anchor point and the fall harness chest strap was not buckled.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: (2) Machine or equipment shutdown. (3) Machine or equipment isolation. (4) Lockout or Tagout. (5) Stored energy. (6) Verification of isolation. (7) Release from lockout or tagout. a) On or about July 8, 2022, employees were exposed to machine hazards associated with the 300-ton Niagara Machine Press during a maintenance activity of replacing a counterbalance shaft. The employer failed to implement the energy control application steps in that the 300-ton Niagara Machine press's pneumatic system was not locked out.
