29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: 1 Portland Rd, Bridgton, ME: The employer did not ensure that a portable ladder used by employees to access the scaffolding and the roof from the deck was either extended 3 feet above the landing surface or secured with a grasping device.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: 1 Portland Road, Bridgton, Maine: The employer did not ensure employees working at least 6 feet above the next lower level were properly trained to properly use fall protection systems in the following instances: a. An employee on the roof measuring 8 feet to the next lower level was not connected to any anchor while traveling from one anchor site to another due to lack of training in proper use of the personal fall arrest system. b. Employees who were using scaffolding to access the roof and to work on the edge of the roof, and who removed multiple sections of guardrails in order to accept materials leaving only upright posts intact, did not have effective training regarding fall protection. Southern Maine Building Solutions was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1550592, citation number 1, item number 2 and was affirmed as a final order on October 29, 2021, with respect to a workplace located at 50 Beal Street, Norway, Maine.
