OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to struck-by hazards  (a)	Breakthrough Resource Management, 8355 E 32nd Ave., Denver, CO 80238, Solana Central Park Project: On or about July 12, 2022, employees were exposed to struck-by hazards while working around an excavator that tipped off the ground while it was being used to lower a trench box into an excavation. At the time of lowering, the excavator was situated on a slope with the front end of the excavator tracks being approximately 4 feet below grade and the back end at approximately at grade.

29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) Breakthrough Resource Management, 8355 E 32nd Ave., Denver, CO 80238, Solana Central Park Project: On or before July 12, 2022, and at times prior, employees of Breakthrough Resource Management were not trained in the recognition and avoidance of unsafe conditions at the jobsite. Employees were not able to recognize or avoid unsafe conditions in the open excavation and were exposed to dangerous conditions such as working in an unprotected protected trench without the knowledge of how to avoid the hazards, or control or eliminate them.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:   (a) Breakthrough Resource Management, 8355 E 32nd Ave., Denver, CO 80238, Solana at Central Park Project: On July 12, 2022, and at times prior, the competent person on-site did not conduct an inspection to recognize unsafe conditions in a trench and allowed workers to enter and work in the trench without protective systems. This exposed workers to cave-in hazards.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a) Breakthrough Resource Management, 8355 E 32nd Ave., Denver, CO 80238, Solana Central Park Project: On or before July 12, 2022, an employee entered a trench 16 feet deep without means of safe egress. The employee entered the trench by scaling down the southwest side of the trench along Uinta St. and did not have a safe means of egress after entry. This exposed employees to cave-in hazards.

This exposed the employees to cave-in hazards.
