29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l) 29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). On or about July 13, 2022, the employer did not provide training for operators of the GEHL RS8-42 telehandler. Employees were exposed to struck-by hazards.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employees were not protected from the hazards associated with / but not limited to rollover incidents while operating a telehandlers without the use of a seat belt. On or about July 13, 2022, employees were engaged in industrial construction operations with one employee operating a GEHL RS8-42 Telehandler while the vehicle was in motion without using the seat belt provided on the vehicle.
