OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards due to deficient design and/or implementation of preventive and/or protective measures in its dust collection system and related equipment: a) CNC and Wood Departments - Belfab enclosureless dust collection systems located indoors were not bonded and grounded to prevent static electrical energy accumulation, on or about July 12, 2022. b) CNC Department - Belfab enclosureless dust collectors located indoors were used for dust pickup other than wood, such as aluminum and Komatex, on or about July 12, 2022. c) CNC Department - A means of tramp metal protection was not provided to keep unwanted metal fragments out of the Belfab enclosureless dust collectors, on or about July 12, 2022. d) CNC and Wood Departments - Collected dust from plastic tilt hoppers located underneath Belfab enclosureless dust collectors was not removed daily or more frequently, if necessary, on or about July 12, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(ii): Employee training did not include the physical and health hazards of the chemicals in the work area: a) CNC and Wood Departments - The employer failed to train employees of the hazards of combustible wood dust created by the process and collected in dust collectors within the work environment, on or about July 12, 2022. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
