OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to excessive heat.  a. On or about and at times prior to July 12, 2022, an employee was exposed to the hazard of high ambient heat from the edger equipment in an open-air facility during the performance of their job duties, including moving and pushing cut wood pieces from a conveyor into the edger machine throughout their 10-hour shift.  At the edger, the WBGT indoor averaged 33.3 C, the relative humidity averaged 30.7%, and the heat index averaged 52.7 C while employees performed the heavy workload. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.  b. On or about and at times prior to July 12, 2022, employees were exposed to the hazard of high ambient heat from the landing table equipment in an open-air facility during the performance of their job duties, including the removal of unwanted boards from the production line throughout their 10-hour shift.  At the landing table, the WBGT indoor averaged 32.9 C, the relative humidity averaged 29.8%, and the heat index averaged 44.7 C  while employees performed the moderate workload. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.

29 CFR  1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:   On or about July 12, 2022, employees were processing wood in a saw mill and were exposed to noise above an 8-hour time weighted average of 85 decibels without the employer having a monitoring program.

29 CFR  1910.95(k)(1):The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k):  On or about July 12, 2022, employees were processing wood in a saw mill and were exposed to noise above an 8-hour time weighted average of 85 decibels without having been trained on the effects of noise on hearing, the attenuation of types of hearing protectors, and the purpose of audiometric testing.
