29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about July 13, 2022, an employee working on the lower tiered roof level of the residential building was not wearing a protective helmet to protect them from roofing scrap materials and equipment that may fall from the upper roof level where roofing work was being performed.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest system.  (a)  On or about July 13, 2022, employees conducting roofing activities on a new residential roof with a 8:12 pitch, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 11 feet on the front of the residential property, and a 21 foot fall hazard on the back of the residential property.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)  On or about July 13, 2022, the employer did not ensure that employees exposed to potential fall hazards had been trained to recognize and minimize the fall hazards associated with their work.

29 CFR  1926.1053(b)(16):Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired.  (a)  On or about July 13, 2022 the portable extension ladder being used for access to the roof of the residential property had damaged (bent) side rails and rungs and the employer did not remove the ladder from service.
