29 CFR  1910.134(c)(1):A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)  (a) Worksite. Employees using grinder to remove concrete were exposed to silica dust. The employer did not develop and implement a respiratory protection program that included medical monitoring, fit testing and training for employees  wearing N95 respirators. On or about 7/13/2022.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)   (a) At the worksite. Employees were working on the third tier of a scaffold platform that was not fully planked.  The employees were approximately 15 feet above the ground and using hand grinder to prepare area to repoint brickwork. On or about 7/13/2022  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.1053(b)(4):Ladder(s) were used for purposes other than the purpose for which they were designed:  (a) Worksite, an A-frame ladder was used in the closed position to access the first tier of scaffold. On or about 7/13/2022.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  (a) Northern Parkway Elementary School located at 440 Northern Pkwy. Uniondale, NY 11553. Employees used a hand held grinder without a shroud and dust collection system on July 13, 2022.   Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
