29 CFR  1910.1200(e)(1):The employer did not develop, implement and maintain at the workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met:  147-25 Northern Blvd. Queens, N.Y.   a) Employees engaged in masonry activities including but not limited to tuckpointing, used hazardous materials, such as but not limited to Lehigh Portland Cement Type I-II (silica 40%), calcium oxide silicate(25-50%). The employer did not develop and implement a hazard communication program; on or about 7/14/2022.    Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

Safety data sheets for hazardous materials were not made readily available; on or about 7/14/2022.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1910.1200(h)(1):The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:  147-25 Northern Blvd. Queens, N.Y.  a) Employees engaged in masonry activities including tuckpointing used hazardous materials, such as but not limited to Lehigh Portland Cement Type I-II (silica (40%), calcium oxide silicate(25-50%). A Hazard Communication training program was not in place; on or about 7/14/2022.   Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
