29 CFR 1910.110(e)(4)(iii): Permanent and removable fuel containers were not securely mounted to prevent jarring loose, slipping, or rotating, or falling:    a) Production Area - On July 28, 2022, the employer did not ensure that the LP gas cylinder located on the back side of the Clark forklift model #C50SL, serial #P4551, and the Mitsubishi forklift model #PG OK, serial #AF 33 B5 0076/B15877, power industrial vehicle (forklift) was properly secured.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.147(c)(4)(ii): The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to items (a) through (d) of this section:   a) Production Area - On July 12, 2022, the employer did not ensure that the energy control procedures that were established, were specific to the equipment such as the Die Bench Machine #2, where it clearly outlined the following: a specific statement of the intended use of the procedure (servicing, maintenance, and/or un-jamming), procedural steps for shutting down, isolating and securing the machine to control hazardous energy (electrical, hydraulic, and pneumatic), procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them, and specific requirements for testing the machine to determine and verify the effectiveness of the lockout devices, tagout devices and other energy control measures.  No abatement certification or documentation is required for this item.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) covered the following elements, however, the actions were not done in sequence as required by 29 CFR 1910.147 (d)(1)-(6):  Production Area - On July 12, 2022, an employee was exposed to machine hazards associated with moving parts while performing servicing and maintemtnce activities, such as set-up, die-changes and unjamming on the Die Bench Machine #2. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work such as set-up, die changes and unjamming the carriage f per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation {(d)(3)/, LOTO device application [(d)(4)}, dissipation of residual energy [(d)(5)], and 1?erification of isolation f(d)(6)], were not implemented to protect the employee from machine servicing hazards.  No abatement certification or documentation is required for this item.

29 CFR 1910.212(a)(1): One or more methods of machine guarding were not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:        a) Production Area - On July 28, 2022, the employer did not ensure that employees were adequately protected from rotating parts on equipment, such as the Schumag North II B, and the Schumag South West II D, Combined Drawing Machines.  The machines had their guards placed in an up position with the machines running.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR  1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition:  a) Production Area - On July 28, 2022, the employer did not ensure that the Toyota model #8FGCU30, serial number, 10571, serial #B875V12474L, Mitsubishi forklift model #PG OK, serial #AF 33 B5 0076/B15877, and the Hyster, model #H120XM, serial #L005V08539D, powered industrial truck(s) with the broken back light, damaged tips, and bent bars on the mast, were withdrawn from service until restored to safe operating condition.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
