29 CFR 1926.250(a)(2)(i): The weight of stored materials on floors within buildings and structures exceeded maximum safe load limits. 267 Mill Street, Worcester, MA: On or about July 15, 2022: In preparation for the replacement of the low sloped roof on the multi unit apartment building, employees were exposed to collapse hazards posed by the stone aggregate that was removed from the roof surface and stored in a concentrated pile on the north side of the buildings roof . The weight of the pile of stored "stone" was calculated and determined to have significantly exceeded the structures maximum safe load limit of 140 pounds per square foot.

1926.501(b)(13) "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. 267 Mill Street, Worcester, MA: On or about July 15, 2022: Employees engaged in roofing activities on a roof with unprotected sides and edges greater than 30 feet above the the next lower level were not protected by either guard rails, safety net systems or personal fall arrest systems exposing them to fall hazards. The Better Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.503(b)(13) , which was contained in OSHA inspection number 1376242, citation number 1, item number 2 and was affirmed as a final order on 03/07/2019, with respect to a workplace located at 175 Greenbush Road, West Warwick, RI.
