29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  a) Production Floor: On or about 7/18/22 the employer did not establish a lockout/tagout program when employees are required to conduct maintenance on machinery such as, but not limited to, Belshaw Proofer model TM600.,Serial No. W0606117 and the Endflex POPLOK AHL-110, Serial No. 21650 . Energy sources include thermal, pneumatic, and electrical.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   a) Production Floor, Donut Cutting Station: On or about 7/18/22 the employer did not ensure that the rotating donut cutting die was guarded, which exposed employees to the rotating die. The opening was about 9" in height and 27.5" in length.

29 CFR  1910.263(c)(3): Sprocket(s) and V-belt drive(s) of bakery machinery located within reach from platform(s) or passageway(s) or located within 8 feet 6 inches from the floor were not completely enclosed:  a) Production Floor (Proofer): On or about 7/18/22 the employer did not ensure that the Proofer conveyor sprocket was guarded. The steel plate that was guarding the  sprocket had been removed.  b) Production floor (M&M Cookie packaging): On or about 7/18/22 the employer did not ensure that the conveyor belt sprockets were adequately guarded on the Safeline metal detector. The guard was taped on and easily removable.
