29 CFR  1910.95(g)(8)(ii)(B):Unless a physician determines that the standard threshold shift is not work-related or aggravated by occupational noise exposure, the employer did not ensure, when a standard threshold shift occurs, that for employees already using hearing protectors, employees be refitted and retrained in the use of hearing protectors and provided with hearing protectors offering greater attenuation if necessary:  (a)	Employees who had a standard threshold shift were not refitted and retrained on the use of hearing protectors, exposing them to noise hazards and continued hearing loss.

29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical.  a) PHOENIX FIELD DIVISION: Employees cleaned weapons using solvents and lubricants containing ototoxic chemicals such as toluene, Stoddard solvents, petroleum distillates, and turpentine, and handled Flash Bang grenades containing pyrotechnic chemicals and lead dithiocyante; and the SDSs were not maintained in the workplace.

29 CFR  1910.95(c)(1):The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a ) PHOENIX FIELD DIVISION: The employer did not implement a Hearing Conservation Program including all the required elements, exposing employees to noise levels which could result in hearing loss. The program did not include a monitoring program to assess exposures to impulse noise from gunfire and explosions as required by 1910.95(d)(1), 1910.95(e), and 1910.95(f); evaluation of hearing protection attenuation under 1910.95(j); and maintaining records under 1910.95(m).    The Bureau of Alcohol, Tobacco, Firearms, and Explosives was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(d)(1), which was contained in OSHA inspection number 1263961, citation number 2, item number 1 and was affirmed as a final order on December 22, 2017 with respect to a workplace located at 151 North Delaware, Rm. 1000, Indianapolis, IN 46204.  The Bureau of Alcohol, Tobacco, Firearms, and Explosives was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95(d)(1) and/or (c)(1), which was contained in OSHA inspection number 1210976, citation number 1, item number 1 and was affirmed as a final order on June 5, 2017 with respect to a workplace located at 201 East Washington, Suite 940, Phoenix, AZ 85004. This violation was abated on August 16, 2018.

29 CFR  1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):    a)	PHOENIX FIELD DIVISION: Employees used chemicals during weapons cleaning, containing ototoxic chemicals such as toluene, Stoddard solvents, Petroleum distillates, and Turpentine, and the employer had not developed a hazard communication program that addressed the elements required under the standard are met, exposing employees to health and physical hazards. The employer's program did not include a list of hazardous chemicals known to be present onsite, the method the employer used to inform employees of hazards from non-routine tasks, the designated person(s) responsible for conducting training and maintaining SDSs, and how the data sheets are to be maintained.  The Bureau of Alcohol, Tobacco, Firearms, and Explosives was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(e)(1), which was contained in OSHA inspection number 1436295, citation number 1 item number 1 and was affirmed as a final order on November 7, 2019, with respect to a workplace located at 200 South Virginia, Ste 600, Reno, NV 89501.
