29 CFR  1910.134(f)(2):Employee(s) using a tight-fitting facepiece respirator were not annually fit tested: Members of the fire brigade who wear tight-fitting elastomeric respirators such as SCBAs, had not been fit tested annually. On July 19, 2022, fire brigade members had responded with SCBAs to fight a transformer fire and had not been fit tested since 2019.

29 CFR  1960.8(c):  The Agency did not develop, implement, and evaluate an occupational safety and health program in accordance with the requirements of section 19 of the Act, Executive Order 12196, and the basic program elements prescribed in this part, or approved alternate program elements:   July 19, 2022:  Although written Emergency Action Plan procedures were developed, the procedures were inadequate or incorrectly implemented which contributed to confusion and delay in the emergency response to a transformer bushing fire. The inadequate or incorrectly implemented procedures included; 1. The page communication system did not deliver a clear and concise notification and direction, 2. A secondary assembly point was not established (the fire took place at the only established assembly point), 3. Personnel accountability was not obtained during and after the incident, and 4. Personnel responsible for providing emergency response support activities to prevent hazards such as heat-related illnesses for employees engaged in firefighting were not established.
