29 CFR 1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:( a) Layton, Inc. located at 4603 Horns Hill Road, Newark, OH 40055: On and/or preceding July 19, 2022, the employer did not ensure that a safe means of egress was located in a trench excavation that was more than 4 feet in depth. An employee was exposed to struck-by hazards while installing a residential water line in a trench that was more than 4 feet deep with an excavator being operated at the top of the sloped end designated for egress. The trench was made up of fine/sandy soil and the end used for egress was sloped at 65 degrees or more which necessitated the use of the employee's hands to egress.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) Layton, Inc. located at 4603 Horns Hill Road, Newark, OH 40055: On and/or preceding July 19, 2022, the employer did not ensure that employees were protected from cave-ins by an adequate protective system while performing work in a trench that was more than five feet in depth. A laborer was working in areas of a trench up to 6 feet deep on a residential water line without a means of cave-in protection in place. The following condition exposed employees to struck-by/caught-in hazards.
