29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. On or about July 2022, the employer did not ensure that all employees involved in the kiln start-up process were wearing the prescribed protective equipment. During the kiln start-up process, the employer requires employees to wear wear Hardhat, safety glasses, HexArmor apron, gloves and arm guards when working in front of open burner doors loading wood. When lighting the fire in the burner, employees must also wear FR rated face shield, shirt and pants, and leather gloves. Employees were observed on video in short sleeves T-shirt, pants, and hardhat.

29 CFR 1910.1200(f)(6):Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked. On or about July 2022, the employer uses an unlabeled container/fire extinguisher filled with fuel to spray on wood in the burner to start the burner. Through interviews and employer statements, the container being used is unlabeled and contains diesel and is stored in the silo near the burner.
