29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a) Cimarron Label, Inc. at 4201 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to July 20, 2022, the employer did not ensure that the Mark Andy Inc. Press #5, model number: 2200-10H,  serial number: 13730 8/2007, was equipped with a properly installed guard or otherwise protected from operator contact with the ingoing nip point drive belt and pulley mechanism located on the west side of machine.  This condition exposed operators to caught-in and amputation hazards.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section:   (a) Cimarron Label, Inc. at 4201 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to July 20, 2022, employees were exposed to chemical hazards in that hazardous chemicals in the workplace were not labeled. One clear bottle containing ethyl acetate, was located on the work bench beside Press #5 of the production floor area was not labeled. This condition exposed employees to injuries with improper use of chemicals.  (b) Cimarron Label, Inc. at 4201 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to July 20, 2022, employees were exposed to chemical hazards in that hazardous chemicals in the workplace were not labeled. One clear bottle containing ethyl acetate, was located on a press workbench in the press area of the production floor was not labeled. This condition exposed employees to injuries associated with improper use of chemicals.

29 CFR 1904.41(a)(2): The employer did not file the annual electronic submission of OSHA Form 300A Summary of Work-Related Injuries and Illnesses by establishments with 20 or more employees but fewer than 250 employees in designated industries. If your establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and your establishment is classified in an industry listed in appendix A to subpart E of this part, then you must electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee. You must submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form:  (a) Cimarron Label, Inc. at 4201 North Westport Avenue, Sioux Falls, SD 57107:  On or about and at times prior to July 20, 2022, the employer failed to electronically submit information from their OSHA Form 300A or equivalent for calendar year 2021. The establishment employed 173 employees and is classified as industry NAICS code 323111 during the calendar year 2021.
