29 CFR  1926.503(a)(1):  The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a.  Located at 779 Westbury Drive, Lot# WEL 248, Pickerington, Ohio:  On or about July 21, 2022, the employer did not provide a training program for his employees exposed to fall hazards.  The employees were not trained to recognize fall hazards with training that offered procedures to adhere to in order to minimize the hazards.  The employees were therefore exposed to fall hazards of nine feet from the top plate of the first story exterior wall and approximately six feet atop the step ladder to the ground level.

29 CFR  1926.20(b)(1):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a.  Located at 779 Westbury Drive, Lot# WEL 248, Pickerington, Ohio:  On or about July 21, 2022, the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction when an employees performed framing work exposed to fall hazards from elevated surfaces and ladders.  Manuel Salto, was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1385204, citation number 1, item number 1 and was affirmed as a final order on May 29, 2019, with respect to a workplace located at 2044 Scenic Bluff Court, Lot 5906, Delaware, Ohio 43015.

29 CFR  1926.501(b)(13):  "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a.  Located at 779 Westbury Drive, Lot# WEL 248, Pickerington, Ohio:  On or about July 21, 2022, the employer failed to ensure that an employee was protected from falling when framing work was done at the top plate of the exterior framed wall.  The employee was therefore exposed to a fall hazard of nine feet from the unprotected side/edge to the ground level.  Manuel Salto, was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1601430, citation number 1, item number 1 and was affirmed as a final order on July 20, 2021, with respect to a workplace located at 579 Courtright Drive East, Pickerington, Ohio 43147.  Manuel Salto, was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1385204, citation number 1, item number 4 and was affirmed as a final order on May 29, 2019, with respect to a workplace located at 2044 Scenic Bluff Court, Lot 5906, Delaware, Ohio 43015.

Located at 779 Westbury Drive, Lot# WEL 248, Pickerington, Ohio:  On or about July 21, 2022, the employer failed to instruct an employee not to use the top step and top of the stepladder when they conducted the framing task.  The employee was therefore exposed to a fall hazard of approximate six feet to the ground level.  Manuel Salto, was previously cited for a serious violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1385204, citation number 1, item number 5 and was affirmed as a final order on May 29, 2019, with respect to a workplace located at 2044 Scenic Bluff Court, Lot 5906, Delaware, Ohio 43015.
