1910.178(l)(4)(ii) Refresher training in relevant topics shall be provided to the operator when: (B):The operator has been involved in an accident or near-miss incident; a) On or about May 10, 2022 an employee operating a powered pallet jack (power truck) in the chill dock was involved in an incident where an employee collided with the pallet jack forks and the pallet jack operator was not provided retraining afterward. b) On or about June 28, 2022, an employee operating a powered pallet jack (power truck) was involved in a near-miss incident where an employee was almost struck by a pallet jack and the pallet jack operator was not provided retraining afterward.

29 CFR 1910.178(l)(2)(i): Trainees may operate a powered industrial truck only: (A) Under the direct supervision of persons who have the knowledge, training, and experience to train operators and evaluate their competence; and (B) Where such operation does not endanger the trainee or other employees. On or about June 28, 2022, an employee was permitted by another pallet jack operator to operate a powered pallet jack before completing the necessary video and written test parts of the employer's PIV training.
